BuzzVote.com Terms of Service

Welcome to Buzzvote.com! Buzzvote.comTM is an online community organized by BUZZVOTE, LLC, ("BUZZVOTE", "we" or "us"), that is developing a collaborative, common resource of information. Buzzvote.com allows anyone who is at least 14 years old with an Internet connection and World Wide Web browser to access polls on about an infinite array of subjects and items and, in some instances, to participate in the creation of polls about these subjects and items. By using the Buzzvote.com website and related services and participating in the Buzzvote.com community, you agree to be bound by these Terms of Service, which set forth what your rights and responsibilities are and what you can expect from us.

Content on Buzzvote.com.

Content on Buzzvote.com may consist of text, graphics, links, logos, button icons, images, audio and video clips, digital downloads, data compilations, and software (collectively, "Content"). On certain areas of Buzzvote.com, visitors can create and post their own Content (BuzzvoteTM). If you choose to post on Buzzvote.com, you may register and submit certain information, including a valid email address. We use this information to screen out users who leave comments prohibited by our site guidelines, and for other purposes described in our privacy policy. If you post polls, you agree to comply with our site guidelines, which are incorporated into this agreement, and with all laws and regulations applicable to your access and use of Buzzvote.com and publishing your polls. We have the right but not the obligation to monitor and edit or remove any activity or content.

All Content included on this site is the property of BUZZVOTE or its content suppliers and protected by United States and international copyright laws, provided that if you post to Buzzvote, you grant us and our visitors a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display polls throughout the world in any media. You also grant us (and our affiliates and sublicensees) the right to use the name that you submit in connection with such content, if they choose. The compilation of all content on this site is the exclusive property of BUZZVOTE and protected by U.S. and international copyright laws.

Third Party Contracts.

From time to time, Buzzvote.com or a partner, may sponsor a promotion, sweepstake or contest on Buzzvote.com. In order to participate you may be asked to provide personal information including your name, email address or home address and/or to answer certain other questions that may be applicable. We will not transfer your personal information to any ad partners unless you have explicitly requested to receive information from them through us rather than directly through them, and if so, we will only provide the necessary information to facilitate your transaction. It will be clear at the point of collection who is collecting the personal information and whose privacy statement will apply.

Replication of Buzzvote.com.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of Buzzvote.com.

Modifications to Service.

We reserve the right at any time to modify or discontinue, temporarily or permanently, Buzzvote.com with or without notice, without liability to you or any third party.

Modifications to Terms of Service.

We can change these terms of service at any time. The current terms of service can always be found at www.buzzvote.com/tos.

Eligibility for Buzzvote Account.

By registering for a Buzzvote Account, you are representing and warranting that all information you submit is truthful and accurate, and that you agree to maintain the accuracy of such information. You further represent and warrant that you are 14 years of age or older and that your use of Buzzvote.com will not violate any applicable law or regulation. Your Membership is solely for your personal use, and you may not authorize others to use your account, including your profile or email address. You are solely responsible for all Content published or displayed through your account, including any email messages, and for your interactions with other members.

Termination of Buzzvote Account.

We, in our sole discretion, may terminate your password, account or use of or access to Buzzvote.com, and remove and discard any Content posted by you, for any reason. Some of the more likely reasons for termination are that you misrepresented your age or provided other inaccurate information in the registration form, or that you acted in violation of the terms or the spirit of these terms of service or other policies. We will have no liability to you or any third party for any termination of your access to any area of the Buzzvote.com website.


By choosing to use Buzzvote.com, you agree to indemnify BUZZVOTE, its officers, agents, partners, and employees from any and all claims or damage, including reasonable attorney's fees, made by third parties due to, or arising out of Content you choose to submit, post or transmit through Buzzvote.com, or of your use of or connection to Buzzvote.com; your violation of these Terms of Service or your violation of any rights of another.

Governing Law/Arbitration.

This agreement is governed by the laws of the State of New York, as such laws apply to agreements entered into and to be performed entirely within New York between residents of New York. Any claim arising out of or relating to this agreement or Buzzvote.com may be settled by binding arbitration in New York County, New York, in accordance with the American Arbitration Association's commercial arbitration rules. Any such claim may be arbitrated on an individual basis, not consolidated with another party's claim.

Copyright Violations.

If you believe content on Buzzvote.com infringes your copyright, you can contact our agent for service of notice at BUZZVOTE LLC, 451 Broome Street, New York, NY 10013, copyright@buzzvote.com. Please make sure your notice meets the Digital Millennium Copyright Act requirements.

Limitation on Liability.



This agreement, our site guidelines and our privacy statement (which is part of this agreement) constitute the entire agreement, and supersede any other agreements or understandings (oral or written), between you and us with respect to their subject matters. We can amend this agreement either by emailing you about the amended terms, which take effect when we send you the email, or by displaying amended terms to you when you log in to Buzzvote.com, which take effect when we post them. Otherwise, this agreement may be amended only by a writing physically signed by both us and you.

General Disclaimers.

BUZZVOTE.COM AND ITS SERVICES ARE PROVIDED "AS IS", and we expressly disclaim any warranty of fitness for a particular purpose or non-infringement. We cannot guarantee and does not promise any specific results from use of Buzzvote.com.

Buzzvote.com is a work in progress, and, as such, postings may contain errors, duplication, or other inconsistencies. We encourage readers to help us correct these matters. Buzzvote.com does not represent that users are subject matter experts or that they have any credentials or expertise in areas on which they may be commenting. Any unenforceable portion of this agreement may be enforced to the maximum extent possible and the remaining portions may be given full effect. Our failure to act in a particular circumstance does not waive our right to act with respect to that or other circumstances. We may be excused for any problem due to a factor beyond our control. Here are the rules you need to follow for submitting content to Buzzvote.com: You are solely responsible for your conduct and any content that you submit or post on Buzzvote.com.

You should not post the same content more than once, unless you are comparing two or more products or services, in which case you may repeat your posting once in each area. You should respect the proprietary and intellectual property rights of others (including trademark, copyright and trade secrecy) in posting content. You may not do any of the following things on Buzzvote.com: Abuse, harass, threaten or intimidate other [visitors] or others who use the Buzzvote.com service, nor may you upload, post or otherwise include any content that is defamatory, libelous, tortuous, vulgar, obscene, invasive of privacy, racially or ethnically objectionable, hateful, promotes or provides instructional information about illegal activities, or promotes any act of cruelty to animals.

  • Impersonate another user or any employee of BUZZVOTE.
  • Use Buzzvote.com for any illegal or unauthorized purpose, or to promote or make solicitations for any illegal or unauthorized activity.
  • Use Buzzvote.com to distribute, share or solicit content belonging to third parties without proper authorization from the owner(s) of that content.
  • Violate any Federal, state or local laws. If you are posting content outside of the United States, you should comply with all local laws regarding online conduct and acceptable content.
  • Modify, adapt or hack the Buzzvote.com website.
  • Create or submit spam to any user.
  • Transmit any worms or viruses or any code of a destructive nature.
  • Transmit content in breach of a confidentiality or fiduciary obligation you may have.
  • Attempt to automatically redirect users to other domains, or mislead users into navigating away from Buzzvote.com.
  • Affect the way Buzzvote.com displays its pages, such as by framing Buzzvote.com or placing pop-up windows over its pages, or otherwise adversely affect the display of any advertising or promotional links on the Buzzvote.com website.
  • Use any automated means to access the site or collect any information from the Buzzvote.com website.
  • Collect any personal information about users through Buzzvote.com.
  • Publish or use files or processes that pose a threat to the proper technical operation of the Buzzvote.com website.
  • Provide any content that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.


Reporting Copyright Problems
17 U.S.C.512 ©(3) (part of the Digital Millennium Copyright Act) provides: To be effective under this subsection, a notification of claimed infringement may be a written communication provided to the designated agent of a service provider that includes substantially the following:

1.A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2.Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

3.Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.

4.Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

5.A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6.A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
